1. Introduction

Welcome to Mont Blanc Photography.. By accessing or using our website and services, you agree to be bound by these Terms & Conditions ("T&Cs"). Please read them carefully. If you do not agree with any part of these terms, you must refrain from using our website and services.

2. Definitions

"We," "Us," "Our":Refers to [Your Business Name], the provider of pet photography services.

"Services":Refers to all photography services offered by us, including but not limited to, pet portrait sessions, digital photo editing, and photo delivery.

"Client," "You," "Your": Refers to the user or customer of our website and services.

“Content": Refers to all photographs, text, images, and other materials available on the website.

3. Services Provided

Mont Blanc Photography offers fine art pet photography services, including portrait sessions, editing, and delivery of high-resolution images. All services are subject to availability and may be subject to changes without notice.

4. Booking and Payment

Booking: A session is confirmed once a booking fee is paid. The booking fee is non-refundable but can be transferred to a different date with 7 days written notice.

Payment: The session fee is due at the time of booking. All print products must be paid for in full before being sent to the client. Payment can be made via bank transfer, twint or stripe.

Cancellations and Rescheduling: Cancellations must be made in writing with 7 days advance notice to reschedule the session. Failure to do so may result in forfeiture of the booking fee.

5. Intellectual Property Rights

All photographs taken during your session are the exclusive property of Mont Blanc Photography. You are granted a limited license to use the images for personal, non-commercial purposes. Any commercial use, reproduction, or distribution, or submission to contests, without written consent from Mont Blanc Photography is strictly prohibited. The client may not edit the photos delivered by Mont Blanc Photography.

6. Client Responsibilities

You agree to cooperate with the photographer, including arriving on time and preparing your pet for the session. You are responsible for the safety and behavior of your pet during the session. Any damage to the photographer's equipment or property caused by your pet will be your responsibility.

7. Limitation of Liability

Mont Blanc Photography is not liable for any injury, loss, or damage caused during the photography session or resulting from the creation of the photographs. While we take utmost care in ensuring animal safety throughout the photo session, the animal’s behaviour remains the responsibility of their owner throughout. While we seek to deliver high-quality images, we are not responsible for technical issues beyond our control, such as printing errors or digital file corruption. Any products that arrive damaged as a result of the printing lab, will be replaced by the lab to ensure the highest quality for the client.

8. Image Delivery and Usage

Image Delivery: Final edited images and products will be delivered within 3-4 weeks after the photo ordering session. Digital files are provided with purchase images as follows: as low web resolution (1800px long side at 72 dpi) suitable for social sharing only, and are not for printing.

Usage Rights: You may use the images for personal use, including sharing on social media, provided that credit is given to Mont Blanc Photography. For any other usage, please contact us for written permission.

9. Privacy and Data Protection

We are committed to protecting your privacy. Personal information collected during the booking process will be used solely for providing our services and will not be shared with third parties without your consent. For more details, please refer to our [Privacy Policy]. We comply with the Swiss Federal Act on Data Protection (FADP) and any other applicable data protection regulations.

10. Dispute Resolution

In the event of any disputes arising from or in connection with these T&Cs, we encourage you to contact us directly to resolve the matter amicably. If a resolution cannot be reached, the dispute will be resolved through arbitration under the rules of the Swiss Chambers' Arbitration Institution (SCAI), and any arbitration proceedings will take place in Switzerland. As per Swiss law, we hold liability insurance to cover our work.

11. Governing Law

These T&Cs are governed by and construed in accordance with the laws of Switzerland. Any legal action or proceeding arising under these T&Cs will be subject to the exclusive jurisdiction of the courts in Vaud, Switzerland.

12. Changes to Terms & Conditions

We reserve the right to update or modify these T&Cs at any time without prior notice. It is your responsibility to review these terms periodically. Your continued use of our website and services following any changes indicates your acceptance of the new terms.
